Tremble — Terms of Service

1. Introductory Provisions

These Terms of Service govern the rights and obligations between AMS Solutions d.o.o. (hereinafter: Controller) and the end user (hereinafter: User) of the Tremble mobile application.

By registering and using Tremble, the User confirms they have read, understood, and irrevocably agree to these Terms. If you do not agree, you must not install or use the application.

2. Definitions

  • Application: The Tremble mobile application, enabling proximity-based discovery of other users via GPS geolocation and Bluetooth technology.
  • User: A natural person who creates a profile and uses the Application.
  • UGC: Content created by users, including profile photos and preference selections.
  • Wave: A single interaction signal sent by one user to another to express interest.
  • Mutual Wave: A match state reached when two users have each sent a Wave to the other.
  • Tremble Premium: The paid premium subscription tier of the Application, sold on the App Store and Google Play under the name Signal Prime. Both names refer to the same tier.

3. Scope of Service

Tremble is designed to facilitate real-life meetings. The Application deliberately does not include a messaging system: there is no text chat, no video chat, and no photo feed or gallery between users.

The one exception is Pulse Intercept, available only between users who have a Mutual Wave. Through it a user may send the other their phone number, or a single view-once photo. A view-once photo is displayed once and is deleted from our storage when it is opened; the Application does not provide a way to save or re-open it, and it is checked automatically for objectionable content. Pulse Intercept is optional at both ends.

The service displays relative proximity between users within detection range; it does not reveal exact coordinates to other users.

The Controller does not guarantee continuous availability and reserves the right to modify, suspend, or discontinue features without prior notice.

4. User Account

  • Age restriction: Use is strictly limited to individuals aged 18 or older. Accounts found to belong to persons under 18 will be permanently deleted.
  • Data accuracy: The User commits to providing truthful information. Impersonation or creating profiles on behalf of third parties is prohibited.
  • Profile visibility: Nearby users see your first name and age when within detection range. Your full profile is revealed only after a Mutual Wave.
  • Non-transferability: Accounts are strictly personal and non-transferable.

5. User Rights and Obligations

  • Real-life safety: The Controller does not conduct background checks. Real-life meetings are at the User's own risk.
  • Prohibited conduct: Harassment, stalking, intimidation, pornographic or violent content, illegal activity, and conduct that endangers others are strictly prohibited.
  • Technical integrity: GPS spoofing, signal boosters, emulators, or technical means to falsify location or bypass security mechanisms are forbidden and may lead to permanent termination.
  • Traffic safety: The Application must not be used while driving or operating any vehicle.
  • Reporting: Users are required to report violations via the built-in Report function.
  • Indemnity: The User agrees to indemnify the Controller against claims, damages, or proceedings arising from violation of these Terms or unlawful use.

6. License (EULA)

The Controller grants the User a personal, revocable, non-exclusive, non-transferable license for non-commercial use of the Application on a personal device.

Reverse engineering, decompilation, or any attempt to derive source code or proprietary algorithms is prohibited. The User declares they are not located in a country subject to applicable export restrictions and are not listed on any prohibited party list. Apple Inc. is a third-party beneficiary of this EULA and may enforce it against the User.

7. Payments and Subscriptions

Pricing: Signal Prime monthly: €7.99/month. Signal Prime annual: €59.99/year. Signal Prime Lifetime: €149.99 one-time. Weekend Getaway: €2.99/week. All prices include applicable VAT.

  • Billing: Payments are processed via Apple App Store or Google Play Store through RevenueCat and are subject to the relevant platform terms.
  • Cancellation: Deleting the app or your account does not cancel an active subscription. Subscriptions must be cancelled manually in your App Store or Google Play settings before the next renewal date.
  • Weekend Getaway: Weekend Getaway is an auto-renewable weekly subscription. Premium features are active only during the weekend window — Friday 19:00 to Sunday 19:00 in your device's current local time zone — and access is not extended beyond that window. The subscription itself renews every week until cancelled, and must be cancelled manually in your App Store or Google Play settings before the next renewal date. No refund is issued for unused time within an activation window.
  • Right of withdrawal: Pursuant to Article 135 of ZVPot-1, by purchasing immediate access to Signal Prime features, the service begins immediately upon payment. The User expressly consents to immediate performance and acknowledges that the right of withdrawal is thereby forfeited.
  • Free tier: Core proximity features are available without a subscription. Signal Prime unlocks expanded radius (250 m), full match history, unlimited Near-Miss notifications, and event heatmaps.

8. Personal Data Protection

Data collection and processing are conducted in accordance with GDPR and ZVOP-2. The full Privacy Policy is available at trembledating.com/privacy and forms an integral part of these Terms.

Ordinary use never stores your precise location — only a coarse area. Proximity records expire after 24 hours and are deleted automatically thereafter. During Precision Finding, exact coordinates expire after 120 seconds and are deleted automatically thereafter; they are never readable inside the app.

When you search for a gym by name, your device sends an approximate position — rounded to roughly one kilometre — together with the text you type, directly to Google's Places API, so that the results are gyms near you. That request does not pass through the Controller's servers and the Controller neither receives nor stores that position. See §2.6 of the Privacy Policy.

The Controller sends transactional email through Resend: a welcome email when you complete onboarding, and an internal safety-alert email when a report or block is filed. No email is sent when you get a match — a mutual wave is announced only by push notification, never by email. See §2.13 of the Privacy Policy.

9. Cookies and Tracking

The Application uses essential technical identifiers (Firebase Crashlytics, Firebase App Check) for stability and security. No trackers for targeted advertising are used within the Application.

10. Third-Party Providers

The Controller uses the following external infrastructure providers: Google LLC (Firebase), Google LLC (Places API), Google LLC (Cloud Vision), Cloudflare Inc., Upstash Inc., Functional Software Inc. (Sentry), Resend Inc., RevenueCat Inc., Apple Inc., and Google Play. The Controller is not liable for service interruptions caused by failures on the part of these providers.

11. Limitation of Liability

  • Technical limitations: GPS and Bluetooth distances are approximate and informative. The Controller is not liable for detection failures in areas with signal interference.
  • Hardware: The Controller is not liable for battery drain or hardware effects resulting from continuous Bluetooth/GPS use.
  • Real-life interactions: The Controller is not liable for physical injury, emotional distress, or damages arising from real-life meetings between users.
  • Maximum liability: To the extent permitted by applicable law, total liability shall not exceed the amount paid by that User in the 12 months preceding the claim.

12. Content Moderation

A zero-tolerance policy applies to objectionable content under Apple App Store Guidelines 1.2. Reports submitted via the in-app Report function will be reviewed within 24 hours. The Controller reserves the right to remove content and suspend or permanently ban accounts without prior notice for violations.

13. Termination

Users may delete their account at any time via Application settings. Deletion is immediate and permanent. Users who cannot access the Application may request deletion at trembledating.com/erasure.

Deleting your account does not cancel an active subscription — see §7. Cancel the subscription in your App Store or Google Play settings before deleting your account.

The Controller reserves the right to suspend or terminate accounts without notice for violations of these Terms.

14. Updates to Terms

The Controller reserves the right to modify these Terms. Users will be notified of material changes via in-app notification or email. Continued use of the Application after changes constitutes acceptance of the updated Terms.

15. Dispute Resolution

Complaints: info@trembledating.com. Slovenian law applies. Exclusive jurisdiction: Court in Koper, Slovenia. EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

16. Language Precedence

These Terms are drafted in Slovenian. In the event of discrepancies between translations, the Slovenian text shall prevail.

17. Final Provisions

If any provision is found void or unenforceable, the remaining provisions remain in full force. These Terms represent the entire agreement between the User and the Controller regarding use of Tremble.
