General Terms of Service and End-User License Agreement (EULA)
1. Introductory Provisions
These General Terms of Service (hereinafter: Terms) govern the rights and obligations between the Controller (AMS Solutions d.o.o.) and the end-user (hereinafter: User) of the Tremble mobile application.
By registering and using the Tremble application, the User confirms they have fully read, understood, and irrevocably agree to these Terms. If you do not agree with the Terms, you must not install or use the application.
2. Definitions
- Application: The Tremble mobile application, which enables meeting people in physical proximity using geolocation and BLE (Bluetooth Low Energy) technology.
- User: A natural person who creates a profile and uses the Application.
- UGC (User Generated Content): Content created by users, including profile photos, descriptions, and preferences.
- Mutual Detection: A technical security mechanism requiring mutual device signal detection before displaying a profile on the radar.
3. Scope of Service
Tremble is a platform designed to encourage real-life interactions. The application deliberately does not include text, image, or video chat features between users. The service operates on the principle of displaying relative distance and direction between users in immediate physical proximity.
4. User Account
- Age Restriction: The use of the Application is strictly restricted to individuals aged 18 or older.
- Data Accuracy: The User commits to entering truthful data. Impersonation and fake profiles are strictly prohibited.
5. User Rights and Obligations
- Real-Life Safety: The Controller does not conduct background checks. The User agrees to exercise caution and engage in real-life meetings at their own risk.
- Prohibited Conduct: Harassment, stalking, intimidation, or any illegal conduct is strictly prohibited.
- Traffic Safety: The Application must not be used while driving or operating any vehicles.
6. License (EULA)
The Controller grants the User a personal, revocable, non-exclusive license to use the Application on a personal mobile device for non-commercial purposes. Misuse of intellectual property (algorithms, source code) is prohibited.
8. Personal Data Protection
Data collection is conducted in accordance with Regulation (EU) 2016/679 (GDPR) and ZVOP-2. Details are governed by the Privacy Policy.
11. Limitation of Liability
The Application is provided "as is". The Controller is not liable for any direct or indirect damages arising from the use of the Application in the physical world.
15. Dispute Resolution
The court in Koper, Slovenia, has exclusive jurisdiction over all disputes. Complaints can be addressed to hello@trembledating.com.
