Terms of Service

These General Terms of Service (hereinafter: Terms) govern the rights and obligations between the Controller (AMS Solutions d.o.o., email: info@trembledating.com) (hereinafter: Controller) and the end-user (hereinafter: User) of the Tremble mobile application.

By registering and using the Tremble application, the User confirms they have fully read, understood, and irrevocably agree to these Terms. If you do not agree with the Terms, you must not install or use the application.

• Application: The Tremble mobile application, which enables meeting people in physical proximity using geolocation and BLE (Bluetooth Low Energy) technology.
• User: A natural person who creates a profile and uses the Application.
• UGC (User Generated Content): Content created by users, including profile photos, descriptions (bio), and preferences.
• Mutual Detection: A technical security mechanism requiring mutual device signal detection before displaying a profile on the radar.

Tremble is a platform designed to encourage real-life interactions. The Application deliberately does not include text, image, or video chat features. The service operates by displaying relative distance and direction between users in immediate physical proximity. The Controller does not guarantee continuous availability and reserves the right to modify or discontinue features without notice.

• Age Restriction: Use is strictly restricted to individuals aged 18 or older. By creating an account, the User guarantees their legal age.
• Data Accuracy: The User commits to entering truthful data. Impersonation or creating profiles for third parties is strictly prohibited.
• Reveal Logic: Nearby potential matches see your first name and age when in range, so they can decide whether to wave. Your photo and full profile remain hidden, and your exact location is never shared. Only after a mutual wave is the full profile revealed and a match confirmed.
• Non-transferability: The account is strictly personal and non-transferable.

• Real-Life Safety: The Controller does not conduct background checks or criminal record verifications. The User agrees to exercise caution and meets others in real life at their own risk.
• Prohibited Conduct: Harassment, stalking, intimidation, distribution of pornographic or violent content, or illegal activities are strictly prohibited.
• Technical Integrity: The use of signal boosters, GPS spoofing, or any technical aids to bypass security mechanisms is explicitly forbidden.
• Traffic Safety: The Application must not be used while driving or operating vehicles.
• Indemnity: The User agrees to indemnify the Controller for any damages, costs, or legal proceedings arising from the User's violation of these Terms or illegal use of the Application.
• Reporting: Users are obliged to report any violations via the built-in "Report" function.

The Controller grants the User a personal, revocable, non-exclusive, non-transferable license for non-commercial use on a personal device. Reverse engineering or attempting to derive the source code or algorithms (Mutual Detection) is prohibited.

The User declares they are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not listed on any prohibited party lists.

• Billing: Payments are processed via Apple App Store or Google Play Store and are subject to their terms.
• Cancellations: Deleting the account or removing the application does not automatically cancel a subscription. This must be done manually in store settings.
• Right of Withdrawal: Pursuant to Article 135 of ZVPot-1, by purchasing immediate access to premium features, the service begins immediately. Consequently, the User loses the right to withdrawal and refund.

Data collection and processing are conducted in accordance with GDPR and ZVOP-2. Precise location data is processed based on consent. Location events are ephemeral and deleted from the database after 10 minutes of inactivity.

The Application uses essential technical identifiers (e.g., Firebase Crashlytics) for stability and security. No cookies or trackers for third-party targeted advertising are used.

The Controller uses external infrastructure providers (Google Cloud, Cloudflare, Resend, Mapbox). The Controller is not liable for interruptions caused by technical failures or force majeure on the side of third-party providers.

• Technical Limitation: The Controller is not liable for the accuracy of GPS and BLE technology. Distances are informative.
• Hardware: Not liable for battery drain, device overheating, or hardware degradation resulting from continuous BLE/GPS use.
• Exclusion of Damages: Not liable for direct or indirect damages, physical injuries, or emotional distress arising from real-life meetings.

Users can delete their account via settings. The Controller reserves the right to block accounts without notice for violations of these Terms (specifically UGC violations or inappropriate behavior).

The Controller reserves the right to unilaterally change these Terms. Significant changes will be notified via the Application or email (support@tremble.app).

A zero-tolerance policy for objectionable content is in place (Apple Guidelines 1.2 UGC). Reports will be reviewed within 24 hours. Apple is a third-party beneficiary of this EULA.

Complaints: info@trembledating.com. Slovenian law applies. Exclusive jurisdiction: Court in Koper, Slovenia. Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

These Terms are drafted in Slovenian. In the event of discrepancies, the Slovenian text shall prevail.

If any provision is found void, it does not affect the validity of other provisions. These Terms represent the entire agreement regarding the use of Tremble.
